Terms of Service
Effective date: [EFFECTIVE DATE]
Last updated: [LAST UPDATED]
These Terms of Service ("Terms") are a binding agreement between you and Quarterback Magazine LLC, a [STATE] limited liability company ("Quarterback Magazine," "QBmag," "we," "us," or "our"). They govern your use of QBmagRANKINGS, including the rankings website at [QBMAGRANKINGS URL], the QB Report Card form, profiles, rankings, emails, texts, social media pages, and any related services (together, the "Services").
Please read Section 18 carefully. It requires most disputes to be resolved by individual binding arbitration, not in court, and waives class actions and jury trials. You can opt out within 30 days (Section 18.7).
By submitting a QB Report Card, creating or claiming a profile, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who may use the Services
1.1 Parents and guardians. The QB Report Card must be completed and submitted by, or together with, a parent or legal guardian of the quarterback. Only a parent or legal guardian may agree to these Terms on behalf of a quarterback who is under 18 (a "Minor").
1.2 Agreement for yourself and your Minor. If you are a parent or guardian, you agree to these Terms on your own behalf and on behalf of your Minor, you confirm you have the legal authority to do so, and you are responsible for your Minor's use of the Services. You agree that you will not later seek to cancel (disaffirm) these Terms based on your Minor's age for any benefit your Minor has already received, to the fullest extent the law allows.
1.3 Quarterbacks. Quarterbacks under 18 may use the Services only with a parent or guardian's involvement and consent. Quarterbacks 18 or older agree to these Terms themselves.
1.4 Children under 13. We do not knowingly collect personal information from a child under 13 without verifiable parental consent, as described in our Privacy Policy. A Rising Stars profile for a child under 13 will not be published until we have obtained that consent.
1.5 Eligible grades. We rank only quarterbacks in the classes we choose to cover from time to time (currently the high school classes of 2027 through 2030, and Rising Stars classes of 2031 through 2033). We do not rank elementary school players.
1.6 United States only. The Services are intended for use in the United States.
2. What QBmagRANKINGS is, and what it is not
2.1 Our own opinion. QBmagRANKINGS rankings, scores, grades, "Rising Stars" designations, comments and evaluations (together, "Rankings") are statements of our opinion, formed by our staff using our own criteria and the information families give us. They are not statements of fact, are not a prediction of future performance, and do not measure a player's worth as an athlete or as a person.
2.2 Not a national ranking. Rankings include only quarterbacks who submitted a QB Report Card or have a profile with us and whom our staff have vetted. They are not a ranking of all quarterbacks in the United States or in any state, class or league, and they are not based on any other service's rankings.
2.3 No guarantees. We do not promise or guarantee that the Services, any Ranking, profile, membership, article, graphic, camp, tour or other service will lead to college recruiting interest, an offer, a scholarship, playing time, admission, a roster spot, exposure, or any other result. Recruiting decisions are made solely by colleges, coaches and others we do not control.
2.4 Not an agent, recruiter or advisor. Quarterback Magazine is a media company. We are not an athlete agent, recruiting agency, scouting service bound by any athletic association, financial advisor, academic advisor, or college admissions counselor. We do not negotiate with colleges or anyone else on your behalf.
2.5 Not affiliated. Unless we say so in writing, we are not affiliated with, endorsed by, or sponsored by the NCAA, NAIA, NJCAA, NFHS, any state high school association, any school, college, conference, league, camp, or the NFL. Names of schools, colleges and other organizations appear only to identify them.
2.6 Eligibility rules are your responsibility. You are solely responsible for knowing and following all rules that apply to the quarterback, including those of the NCAA, NAIA, NJCAA, state high school associations, schools, and any name, image and likeness ("NIL") laws or policies. We do not pay quarterbacks or families for appearing in the Rankings. Paid services you buy from us are purchases by you, not payments to you.
3. How rankings work, and our ranking promise
3.1 Free. Submitting a QB Report Card, having a profile, and being ranked are free.
3.2 Paying never changes a ranking. Memberships, Featured or Member Spotlight placements, articles, graphics, college tours and any other paid service, sponsorship or partnership never raise, lower, hold or otherwise affect a Ranking. Paid placements are labeled as paid and kept separate from the Rankings. Our full policy is published on the site and is part of these Terms.
3.3 Our criteria and discretion. We score quarterbacks using criteria and weights we publish on the site (currently on-field stats, academics, camps and training, offseason competition, college tours, volunteering, and character and family). We may change the criteria, weights, scoring guide, classes covered, update schedule or format at any time, prospectively. Within those criteria, every scoring decision is made in our sole editorial judgment.
3.4 Verification. Only information our staff can verify counts. We may contact you, your quarterback, coaches, teachers, schools, and the references you list, and check public sources such as MaxPreps or Hudl, to verify information. Information we cannot verify may be scored as zero or left out.
3.5 No right to a ranking. Submitting a QB Report Card does not entitle anyone to be ranked, to any particular Ranking, or to remain ranked. We may decline to rank, un-rank, delay, or remove any profile or Ranking at any time for any lawful reason, including incomplete or unverifiable information, suspected false information, safety concerns, a request from a parent or guardian, or a violation of these Terms.
3.6 Updates and errors. We aim to update Rankings weekly, but schedules can change. Rankings may contain errors or reflect outdated information. If you believe something is wrong, tell us at info@qbmagrankings.com and we will review factual errors (for example, a misspelled name, the wrong school or class) promptly.
3.7 One appeal per season. Each family may request one review of a quarterback's score per season. A different staff member will rescore using the same written guide. The result of that review is final for that season.
4. Your QB Report Card and the information you give us
4.1 Accuracy. You promise that everything you submit is true, accurate, current and complete, that it is about the quarterback named, and that you will update it if it changes. Submitting false, exaggerated or misleading information (including stats, GPA, camps, visits, service hours or references) may result in removal from the Rankings and a ban from future Rankings.
4.2 Your references. If you list a coach, teacher or other reference, you confirm that person has agreed to be contacted by us to verify information about the quarterback.
4.3 Consent to verify. You authorize us to contact you and your references and to review public sources to verify what you submit.
5. Photos, videos and other content you submit
5.1 You keep ownership. You (or the quarterback) keep ownership of photos, videos, film links, stats, text and other material you submit ("Your Content").
5.2 License to us. You grant Quarterback Magazine and its affiliates a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers and media partners acting for us), transferable (with our business) license to host, store, copy, display, publish, crop, edit for length and format, and distribute Your Content, and the quarterback's name, nickname, image, likeness, school, class, hometown state, stats and biographical information, in connection with: (a) the Rankings, profiles and Services; (b) editorial content about the Rankings, including articles, lists, graphics, videos and social media posts by QBmagRANKINGS, Quarterback Magazine and their official accounts; and (c) promoting the Rankings and the Services.
We will not use a quarterback's name or likeness to say or imply that the quarterback endorses a third-party product or service without separate written permission from a parent or guardian (or the quarterback, if 18 or older).
5.3 How long the license lasts. The license lasts while the profile is active. If you ask us to remove a profile (Section 10), we will stop new uses and remove the profile and Your Content from the site within a reasonable time. You agree we are not required to delete or recall (i) Rankings, articles, graphics or posts already published or printed before your request, including social media posts shared by others, (ii) historical archives of past Rankings (we may keep the quarterback's name, class, school and past rank in archived lists unless the law requires otherwise), or (iii) backup copies kept for a limited time.
5.4 Your promises about Your Content. You promise that you own or have permission to use Your Content and to grant the license above, including permission from the photographer and from any other identifiable person shown; that Your Content does not violate anyone's copyright, trademark, privacy, publicity or other rights; and that it is not unlawful, obscene, harassing, hateful or misleading. Do not submit photos that show other minors' faces unless you have their parents' permission. Do not submit content that includes school logos or team photos you are not allowed to use.
5.5 Our right to remove. We may refuse, crop, edit or remove any of Your Content at any time.
5.6 Feedback. If you send us ideas or suggestions about the Services, we may use them without any obligation to you.
6. Our content and trademarks
6.1 The Services, including the Rankings, scores, scoring methods, lists, text, graphics, logos, designs, software and the "QBmagRANKINGS," "QBmag," "Quarterback Magazine," "QB Report Card" and "Rising Stars" names and logos (excluding Your Content), are owned by Quarterback Magazine LLC or its licensors and are protected by copyright, trademark and other laws.
6.2 Sharing your own ranking. You may share a link to a quarterback's own profile or Ranking, and post a screenshot or our official graphic of your own quarterback's Ranking on personal social media, as long as you do not alter it and you credit "QBmagRANKINGS."
6.3 What you may not do. Except as allowed above, you may not copy, republish, sell, license, frame, or create derivative works from the Rankings or our content, or use our names or logos, without our written permission. You may not suggest that we endorse you, your camp, your business or your product.
7. Paid services
7.1 Optional. Memberships, Spotlight placements, articles, graphics, college tours, camps, events, merchandise and other paid services ("Paid Services") are optional and never affect Rankings (Section 3.2).
7.2 Who sells them. Paid Services are sold by Quarterback Magazine LLC, usually through quarterbackmagazine.com or a separate order page. The price, what is included, billing frequency, and any specific refund rules are shown at checkout or on the order page ("Offer Terms"). Offer Terms are part of these Terms; if they conflict with these Terms, the Offer Terms control for that Paid Service.
7.3 Automatic renewal. Memberships and other subscriptions renew automatically at the end of each billing period (for example, monthly) and your payment method will be charged the then-current price until you cancel. Before you buy, we will show you the price, billing frequency, and how to cancel. We will send a confirmation that includes these terms and how to cancel. If we raise the price of your subscription, we will notify you in advance and you may cancel before the new price applies.
7.4 How to cancel. You may cancel at any time by [ONLINE CANCEL LINK OR ACCOUNT PAGE] or by emailing info@qbmagrankings.com. Cancellation takes effect at the end of the current billing period, and you keep the benefits until then. Canceling a Paid Service never removes or changes a quarterback's free profile or Ranking.
7.5 Refunds. Unless the Offer Terms say otherwise or the law requires more: (a) you may request a full refund of a first-time membership purchase within 5 days of purchase; (b) a renewal charge is refundable if you ask within 24 hours of the charge; and (c) work already delivered (for example, a published article or a delivered graphic), deposits and application fees for tours, camps and events, and fees for events that have already occurred are non-refundable. Request refunds at info@qbmagrankings.com. If we cancel a Paid Service or event, we will refund amounts paid for the part not delivered.
7.6 Payments. You authorize us and our payment processor to charge your payment method for Paid Services you order, plus any applicable taxes. You must provide accurate billing information. We do not store full card numbers; our payment processor does.
7.7 Tours, camps and events. Participation in any tour, camp or in-person event requires the signed participation agreement, liability waiver, medical release and other forms we require for that event. Those documents control the event.
8. Calls, texts and emails
8.1 You agree that we may contact you and your quarterback by email, phone call and text message at the contact information you give us to verify information, deliver the Services, send Ranking updates, and handle your account. Message and data rates may apply.
8.2 We will send marketing texts or prerecorded or automated marketing calls only if you separately give prior express written consent, which is never a condition of being ranked or of any purchase. Reply STOP to any text to stop texts, or use the unsubscribe link in any marketing email.
9. Rules of conduct
You agree not to: - submit false information, impersonate anyone, or submit a Report Card for a quarterback who is not your child or ward (unless you are the quarterback and 18 or older); - harass, threaten, bully, or post negative or abusive comments about any quarterback, family, coach or staff member, including about another player's Ranking; - contact, solicit or attempt to meet any Minor you find through the Services, or use the Services to collect information about Minors; - scrape, crawl, data-mine, or use bots or automated tools to copy the Rankings or profiles, or use them to build a competing database or to train artificial intelligence or machine learning models; - interfere with the Services' security or operation, or access any non-public area or data; - use the Services for any unlawful purpose, or to violate any athletic association rule; or - attempt to pay, pressure or offer anything of value to our staff to influence a Ranking (if anyone offers to change a Ranking for money, report it to info@qbmagrankings.com).
We may suspend or end access for anyone who violates these rules.
10. Removing a profile or ending these Terms
10.1 You may leave at any time. A parent or guardian (or a quarterback 18 or older) may ask us to remove a profile and Ranking at any time by emailing info@qbmagrankings.com from the parent email on file. We will verify the request and remove the profile as described in Section 5.3 and our Privacy Policy.
10.2 We may end access. We may suspend or end your access to the Services, or remove any profile, at any time, with or without notice, including for violations of these Terms. If we end a Paid Service for no reason related to your conduct, we will refund the unused part.
10.3 What survives. Sections 2, 3.5, 5.2 to 5.6 (as limited by 5.3), 6, 7.5, 11 through 19, and any other terms that by their nature should survive, survive termination.
11. Third-party sites, services and partners
The Services may link to or include content from third parties, such as Hudl, YouTube, MaxPreps, social media platforms, Typeform, payment processors, camps, and our partners. We do not control and are not responsible for third-party sites, services, content, products or privacy practices. Partners and sponsors never affect Rankings. Your dealings with third parties are solely between you and them.
12. Copyright complaints (DMCA)
If you believe content on the Services infringes your copyright, send a notice to our designated agent with the information required by 17 U.S.C. § 512(c)(3) (your signature, the work, the infringing material and its location, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act).
Designated agent: [NAME], Quarterback Magazine LLC, [MAILING ADDRESS], info@qbmagrankings.com.
We may remove content and will terminate repeat infringers in appropriate circumstances.
13. Disclaimers
THE SERVICES, RANKINGS AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, QUARTERBACK MAGAZINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. RANKINGS ARE OPINIONS AND MAY CONTAIN ERRORS. YOU USE THE SERVICES AND RELY ON ANY RANKING AT YOUR OWN RISK. NOTHING ON THE SERVICES IS MEDICAL, TRAINING, ACADEMIC, LEGAL, FINANCIAL OR ELIGIBILITY ADVICE. CONSULT A QUALIFIED PROFESSIONAL BEFORE STARTING ANY TRAINING PROGRAM.
14. Limitation of liability
14.1 TO THE FULLEST EXTENT ALLOWED BY LAW, QUARTERBACK MAGAZINE LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, PARTNERS AND LICENSORS (THE "QBMAG PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF OPPORTUNITY, SCHOLARSHIP, RECRUITING INTEREST, PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR ANY RANKING, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
14.2 TO THE FULLEST EXTENT ALLOWED BY LAW, THE QBMAG PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US FOR PAID SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14.3 Some states do not allow some of these exclusions or limits, so some may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or gross negligence where the law forbids limiting it.
15. Indemnity
To the fullest extent allowed by law, you (and, for a Minor, the parent or guardian who accepted these Terms) agree to defend, indemnify and hold harmless the QBmag Parties from and against all claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising from or related to (a) Your Content, (b) false or inaccurate information you submit, (c) your or your Minor's violation of these Terms or of anyone's rights, or (d) your or your Minor's violation of any law or athletic association rule. We may assume control of the defense at our expense, and you will cooperate.
16. Changes to the Services and these Terms
We may change, suspend or discontinue any part of the Services at any time. We may update these Terms by posting the new version with a new "Last updated" date. If a change is material, we will give reasonable notice (for example, by email to the parent email on file or a notice on the site) before it takes effect. Changes apply going forward and do not apply to disputes that arose before the change. Continuing to use the Services after the effective date means you accept the updated Terms. Changes to Section 18 will not apply to any dispute of which we had notice before the change.
17. Governing law
These Terms are governed by the laws of the State of California and applicable federal law (including the Federal Arbitration Act), without regard to conflict-of-law rules. Subject to Section 18, any claim not subject to arbitration must be brought exclusively in the state or federal courts located in [COUNTY] County, California, and you and we consent to personal jurisdiction there.
18. Dispute resolution: binding arbitration and class action waiver
18.1 Talk to us first. Before filing any claim, you agree to email info@qbmagrankings.com with a description of the dispute and the relief you want, and to try in good faith to resolve it with us for 60 days. We agree to do the same before bringing a claim against you.
18.2 Arbitration. If we cannot resolve it, you and we agree that any dispute, claim or controversy arising from or relating to these Terms, the Services, any Ranking, or any Paid Service (each, a "Claim") will be resolved by final and binding individual arbitration, except as stated in Section 18.4. The arbitrator, and not a court, decides all questions about whether a Claim must be arbitrated, except that a court decides questions about Section 18.5 (class action waiver).
18.3 Rules and location. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (available at adr.org), before a single arbitrator. The arbitration may be conducted by video, phone or written submissions, or in person in the county where you live or another place we both agree to. For Claims under $10,000, we will pay all AAA filing, administration and arbitrator fees that exceed what you would pay to file in court, unless the arbitrator finds your Claim frivolous. Each side pays its own attorneys' fees unless the law or the arbitrator awards otherwise.
18.4 Exceptions. Either of us may (a) bring an individual Claim in small claims court if it qualifies, and (b) seek an injunction in court to stop actual or threatened infringement or misuse of intellectual property, unauthorized scraping, or harm to minors' safety.
18.5 Class action and jury trial waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If this class action waiver is found unenforceable as to a particular Claim, that Claim (and only that Claim) will be severed and decided in court, after all individual arbitrations are finished.
18.6 Mass filings. If 25 or more similar Claims are filed against us by or with the help of the same or coordinated counsel, they will be administered in batches of up to 25 under the AAA's mass arbitration procedures, and the statute of limitations is paused for Claims waiting in later batches.
18.7 30-day opt-out. You may opt out of this arbitration agreement by emailing info@qbmagrankings.com within 30 days after you first accept these Terms, with the subject "Arbitration Opt-Out" and your name, the quarterback's name, and the parent email on file. Opting out does not affect any other part of these Terms.
18.8 Time limit. To the extent allowed by law, any Claim must be brought within one (1) year after it arises, or it is permanently barred.
19. General
19.1 Entire agreement. These Terms, the Privacy Policy, our Ranking Policy and any Offer Terms are the entire agreement between you and us about the Services.
19.2 Severability. If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be enforced to the maximum extent allowed.
19.3 No waiver. Our failure to enforce any part is not a waiver.
19.4 Assignment. You may not transfer these Terms. We may assign them, including to an affiliate or in a merger, acquisition or sale of assets.
19.5 Section 230. Nothing in these Terms waives any protection we have under 47 U.S.C. § 230 or similar laws for content provided by others.
19.6 Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
19.7 Electronic communications. You agree to receive notices, agreements and disclosures electronically, and that they satisfy any requirement that they be in writing.
19.8 California users. Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
19.9 Headings. Headings are for convenience only. "Including" means "including without limitation."
